Terms of Service

Replayful (the “Service”) is a hosted session-replay tool operated by D3 Vitamin (“we”, “us”, “our”) at replayful.co. By signing up for an account or embedding the Replayful tracker on a website, you agree to these Terms.

You must provide a valid email when signing up. You are responsible for the activity on your account. You may not share account credentials. We may suspend or terminate accounts that we believe have been compromised, abused, or used to violate these Terms.

When you embed the Replayful tracker on a website you control or operate on behalf of a client, you agree to:

• Disclose the use of Replayful in your own privacy policy. A ready-to-paste snippet is available on the privacy page.
• Use the recordings only for product analytics and visitor-experience research — not for invasive surveillance, harassment, targeting individuals, or any unlawful purpose.
• Take reasonable steps not to circumvent the masking the tracker applies (e.g. by re-rendering masked field values into the DOM in order to capture them).
• Not use Replayful on websites primarily directed at children under 13, on websites that handle protected health information, or where local law prohibits session recording without explicit consent that you have not obtained.

We actively monitor for misuse. We may delete data and terminate accounts that violate this section, with or without notice. We may act on credible reports from third parties.

The Free plan is provided without charge. Paid plans are billed in advance on a monthly basis. We may change pricing with at least 30 days' notice; existing subscriptions are honoured until the end of the current billing period.

If you exceed your monthly session cap, new sessions stop being recorded for the remainder of the month. Existing sessions remain replayable. Counters reset on the 1st of each month. You can upgrade at any time to immediately raise the cap.

Refunds are not offered for partial months. You can downgrade or cancel at any time; downgrades take effect at the end of the current billing period.

You own the session data recorded through your account. We process it on your behalf as a data processor under GDPR / POPIA. Detail in our privacy policy.

When you cancel your account, your data is deleted within 30 days. You can request earlier deletion by emailing nick@odinside.tech.

We aim for high availability but provide the Service on an “as is” basis without uptime guarantees on the Free, Starter, Growth, or Agency plans. Enterprise customers may receive a written SLA as part of their contract.

We may add, change, or remove features at any time. Material changes will be communicated by email or in-app notice.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, D3 Vitamin's aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

You agree to indemnify and hold harmless D3 Vitamin from any claims arising out of your use of the Service in violation of these Terms or applicable law, including but not limited to claims by your visitors that you collected recordings without lawful basis.

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be brought in the courts of South Africa, unless local consumer-protection law gives you a non-waivable right to sue locally.

We may revise these Terms from time to time. The current version is always at this URL with the “Last updated” date below. Material changes will be emailed to active accounts at least 14 days before they take effect; continued use after that constitutes acceptance.
